WAGE GARNISHMENT IN ONTARIO
If you’ve defaulted on a debt, creditors can sue. If a judgment is obtained, a writ of seizure can be issued resulting in an Order of Garnishee. In Ontario the amount of garnishee is governed by the Wages Act.
- Commercial debts can be garnished up to 20%
- Family support debts can be garnished up to the 50%
- If you receive notice you’re being sued, you can put in a defence, and perhaps negotiate a better payment plan
- Entering into either a bankruptcy or consumer proposal will cease any garnishment (with the exception of family support)
